A pilot program managed by King County Solid Waste Division and the Local Hazardous Waste Management Program is helping public and private vehicle fleet managers and technicians safely remove and recover mercury-containing tilt switches in many vehicles. The U.S. Marine Corps has awarded a firm, fixed price indefinite-delivery/indefinite-quantity (IDIQ) contract for vehicle data recording units for vehicles at five Marine Corp locations in California including the Marine Corps Air Station Miramar, Camp Pendleton Base, San Diego Recruit Depot, Twenty-nine Palms Air Ground Combat Center and Mountain Warfare Training Center. News Few Entities Produce Performance Based Contracts Despite the chatter on National Institute of Governmental Purchasers' (NIGP) electronic discussion lists and during the annual Forum, only one of three public purchasers are taking advantage of performance based contracts - according to a recent NIGP Pulse Poll. This result was surprising - especially in light of the fact that the Federal Government's Office of Management and Budget (OMB) established a goal of making 20% of all eligible service contract dollars over $25,000 performance based. A recent Pricewaterhouse Coopers study indicated that state and local governments are quickly embracing performance based service contracting. However, it should be noted that, of those agencies that are using performance based techniques, most have increased their use in the last 2 years. And, of equal interest, 44% of these responding to the Pulse Poll indicated that they were considering performance based contracts in the future. For those agencies that use the technique, the majority indicated that they included both incentives and penalties in their contracts - while 25% only focused on penalties for poor performance. DoD Adheres to Contract Requirements According to the Government Accountability Office (GAO), a bipartisan Congressional watchdog group, the Department of Defense (DoD) and prime contractors have adhered to requirements in selected contracts for overseeing spare parts quality. The GAO's review of 15 contracts showed that quality assurance personnel within the Defense Contract Management Agency (DCMA)--DoD's primary organization for providing quality assurance oversight--generally followed established policies, guidance, regulations, and contract requirements. This oversight ranged from physical inspection of parts to evaluating contractor production processes and counting the number of parts. The review also found the DCMA held prime contractors accountable for their subcontractors' work by requiring that the prime contractors adhere to contract clauses concerning oversight responsibility.
